Question

We propose deleting the requirement for a isolation room. This requirement is included in the new decree on minimum technical requirements for institutional facilities, which replaces the original decree and specifies the need for an isolation room in specialized hospitals; this requirement does not apply to general hospitals.

Answer

The requirement for an isolation room stems from the need to ensure the provision of a Level II Psychiatric Program in accordance with applicable law. Decree No. 358/2023 Z. z. regulates isolation as a means of restraint, and its implementation is contingent upon the availability of an isolation room. This requirement therefore also applies to general hospitals providing a Level II Psychiatric Program. At the same time, providers have been given sufficient time to comply, namely until January 1, 2030. For the reasons stated above, there is no justification for its deletion.
